1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the DataSignal AI platform, website, and services (collectively, the "Services") operated by DataSignal AI LLC ("DataSignal AI," "we," "us," or "our"), a Florida limited liability company.
By creating an account, purchasing a subscription, or using any part of our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.
2. Description of Services
DataSignal AI provides an AI-powered insurance lead generation platform that:
Aggregates and processes publicly available Florida government records from sources including Sunbiz business filings, county property records, building permits, Department of Business and Professional Regulation (DBPR) data, and workers compensation filings
Scores, enriches, and categorizes leads for insurance agents and agencies
Delivers leads via a Streamlit dashboard, CSV exports, and email delivery
Provides sales scripts, CRM pipeline tools, and coverage recommendation engines
Offers subscription plans and individual lead purchases
3. Eligibility
You must be at least 18 years of age and a licensed insurance agent or agency representative to use our Services. By using DataSignal AI, you represent that you meet these requirements. We reserve the right to verify licensing status and suspend accounts that do not comply.
4. Account Registration
To access the platform, you must create an account and provide accurate, complete information. You are responsible for:
Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Notifying us immediately at raul@datasignalai.tech if you suspect unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Subscription Plans and Payment
DataSignal AI offers the following subscription tiers:
Starter ($199/mo): 1 county, up to 100 leads/month, shared delivery
Growth ($499/mo): 1 county, up to 300 leads/month, semi-exclusive delivery
Pro ($999/mo): 1 county, up to 500 leads/month, exclusive delivery
Territory Domination ($2,500/mo per county): Full county lockout, unlimited leads, real-time alerts, weekly strategy call, dedicated support. Additional counties available at $500/mo each with volume discounts on 5+.
Done-For-You ($10,000 setup + $2,500/mo): White-label dashboard, configured pipelines, full sales and marketing plan, 90 days of weekly strategy calls. Terms governed by a separate service agreement.
Subscriptions are billed monthly. Payment is processed via Stripe (USD) or Coinbase Commerce (Bitcoin). A 10% discount applies to Bitcoin payments. All sales are final. By subscribing, you authorize recurring charges until you cancel.
5a. Grand Slam Performance Guarantee
DataSignal AI offers a performance guarantee on all monthly subscription plans (the "Grand Slam Guarantee"). If fewer than three (3) insurance policies are bound from DataSignal AI leads during your first thirty (30) days of paid service, your next full month of service will be provided at no additional charge.
Nature of the Remedy. The Grand Slam Guarantee is fulfilled exclusively through an additional month of service at no charge. It is not a cash refund and does not reduce, offset, or return any amounts already paid. Month 1 remains paid, non-refundable, and non-creditable regardless of outcome. Consistent with Section 6, DataSignal AI does not issue cash refunds under any circumstance, including under this guarantee.
Automatic Trigger (Delivery Failure). If DataSignal AI fails to deliver at least three (3) qualified leads in the 30-day window matching your selected categories and counties, the next month of service is provided free automatically with no claim form required. A "qualified lead" for this purpose means a lead that (i) matches your selected insurance categories and county filters, (ii) was generated within the prior 14 days (freshness threshold), and (iii) includes verified contact data (phone or email with MX verification).
Claim-Based Trigger (Activity-Gated). If DataSignal AI delivered three (3) or more qualified leads and you assert that fewer than three (3) policies were bound from those leads, a valid claim for the free month requires ALL of the following, submitted within seven (7) days of the end of the 30-day window by emailing raul@datasignalai.tech:
A log of contact attempts on every delivered lead, made within seven (7) days of the respective delivery date. Contact attempts must be recorded via the DataSignal AI dashboard "log contact" function, an AgencyZoom activity record, an SMS/MMS log, or an outbound email in which raul@datasignalai.tech is CC'd or BCC'd. Claims submitted without a contact log on every delivered lead are invalid.
A CRM export, AgencyZoom OAuth connection, bound-policy screenshots (declarations page or binder with policy number), or a written sworn statement signed under penalty of perjury stating that fewer than three (3) policies were bound from DataSignal AI leads during the window.
Your active subscription email and subscription plan at the time of the claim.
DataSignal AI will review valid claims within five (5) business days. If approved, the next billing cycle will be credited at 100% (one free month of service). The free month is applied to continued service only. If you cancel or fail to renew, the free month is forfeited and no cash equivalent is issued.
Ineligibility. The Grand Slam Guarantee does not apply to: (a) Starter or single-lead purchases, (b) the $29 taste-test offer or any one-time lead purchase, (c) accounts in violation of Sections 8 or 8a (acceptable use and telemarketing compliance), (d) accounts where the Subscriber failed to maintain an active insurance license in good standing during the window, (e) accounts suspended or terminated for cause during the window, or (f) claims submitted after the seven (7) day post-window window.
Fraud and Chargebacks. Submission of a claim containing false statements, fabricated contact logs, or fabricated CRM data is grounds for immediate account termination without remedy and may be referred to Florida law enforcement or the Florida Department of Financial Services. Filing a payment-card chargeback in lieu of submitting a valid Grand Slam claim waives all rights under this Section 5a, terminates the subscription, and may result in collection of service delivered and reasonable attorneys' fees.
Evidence and Audit. DataSignal AI logs all lead deliveries, dashboard sessions, contact-log entries, and subscription events. These logs are the authoritative record for guarantee administration and dispute resolution, and by subscribing you acknowledge and agree to their use as evidence in any dispute.
5b. Territory Domination Terms
Territory Domination subscriptions grant exclusive access to all leads within specified Florida counties ("Locked Counties"). While your subscription is active, no other subscriber will receive leads from your Locked Counties. Upon cancellation, county lockouts are released at the end of the current billing period. DataSignal AI does not guarantee a minimum lead volume for any county. County availability is first-come, first-served and subject to existing lockout agreements.
6. Cancellation and Refund Policy
You may cancel your subscription at any time through your account settings or by contacting raul@datasignalai.tech. Cancellation takes effect at the end of the current billing period.
Due to the nature of lead data delivery, DataSignal AI does not offer cash refunds on delivered leads or completed billing periods. Leads are generated from public government records and represent pre-intent signals. DataSignal AI does not guarantee that any lead will result in a sale, policy, or commission.
6a. Lead Quality Disputes
DataSignal AI stands behind the quality of its data sourcing. If you believe a delivered lead contains a material error — such as a demonstrably incorrect name, address, or business that does not exist — you may submit a dispute within 7 days of delivery by emailing raul@datasignalai.tech with the following:
Your account email and active subscription plan
The lead ID or lead name in question
The specific error or inaccuracy identified
Any supporting documentation or evidence
DataSignal AI will review all disputes within 5 business days. Approved disputes are resolved as follows:
Lead credits do not expire and are applied to your next billing cycle. A replacement lead may occasionally be issued at DataSignal AI's sole discretion for disputes involving demonstrably incorrect contact information only — this is not a guaranteed remedy and is offered in lieu of, not in addition to, a credit.
The following are explicitly not eligible for dispute or credit:
Leads where the contact did not answer or respond to outreach attempts
Leads where the prospect declined insurance or expressed no interest
Leads where the agent made contact but did not close the sale
Leads that are accurate but not the agent's preferred demographic, coverage type, or territory
Leads submitted for dispute after 7 days of delivery
Leads on cancelled or expired subscriptions
DataSignal AI does not issue cash refunds for disputed leads under any circumstances. Our maximum obligation is a lead credit or, at our sole discretion, a replacement lead.
7. Lead Data and No Guarantee
All leads provided by DataSignal AI are sourced from publicly available government databases. DataSignal AI makes no representations or warranties regarding:
The accuracy, completeness, or timeliness of lead contact information
The insurance eligibility or purchasing intent of any individual in our database
Conversion rates, close rates, commission amounts, or revenue outcomes
The exclusivity of leads on Starter or Growth plans (shared and semi-exclusive respectively)
You acknowledge that lead generation involves inherent uncertainty and that results will vary based on your outreach strategy, market conditions, and individual lead circumstances.
7a. Scope of Exclusivity (Per-Category Rule)
Exclusivity on all plans is scoped per insurance category, not per person. Some prospects appear in our database in more than one capacity. For example, a business owner may appear once as a business lead for commercial coverage and separately as a personal lead for life, umbrella, homeowners, or personal auto coverage. These are treated as distinct lead records with distinct insurance categories. Exclusive and semi-exclusive plans guarantee that no other subscriber will receive the same lead record for the same insurance category. They do not guarantee that the same individual will never be contacted by another agent selling a different, non-competing line of insurance. To reduce same-day double outreach, once either record in a paired business and personal set is delivered, the other record is suppressed from our delivery pool for 48 hours.
8. Acceptable Use
By using our Services, you agree to:
Use leads solely for lawful insurance solicitation in compliance with Florida law and all applicable state and federal regulations
Comply with the CAN-SPAM Act, TCPA, Florida Telemarketing Act, and all applicable do-not-call regulations
Not resell, redistribute, or share lead data with third parties without written consent from DataSignal AI
Not use the platform for any unlawful, harassing, or deceptive purpose
Maintain your own valid Florida insurance license in good standing
Violation of acceptable use policies may result in immediate account termination without refund.
9. Intellectual Property
All platform software, dashboards, scoring algorithms, sales scripts, branding, and content are the intellectual property of DataSignal AI LLC. You receive a limited, non-exclusive, non-transferable license to use the platform for your internal business purposes during an active subscription.
You may not copy, reverse engineer, resell, or create derivative works from any part of the DataSignal AI platform without express written permission.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATASIGNAL AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICES.
DataSignal AI's total liability to you for any claim arising out of or related to these Terms shall not exceed the amount paid by you to DataSignal AI in the three (3) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless DataSignal AI LLC and its officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any applicable law or third-party right.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida. You consent to exclusive jurisdiction and venue in these courts.
13. Modifications to Terms
DataSignal AI reserves the right to update these Terms at any time. We will notify active subscribers via email at least 14 days before material changes take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
14. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, fraudulent activity, or for any other reason at our discretion. Upon termination, your license to use the platform immediately ends.
